Agreement to Terms

By downloading, installing, or using Quietly – Sleep Program ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Quietly ("we," "our," or "us").

Description of Service

Quietly is a wellness application designed to support healthy sleep habits through:

• A 7-day guided sleep improvement program
• Breathing and relaxation exercises
• Personal progress tracking
• Optional audio recording features for self-monitoring
• Daily journaling and reflection tools

Not Medical Advice

Important: Quietly is a wellness app and is NOT a medical device. The App:

• Does not provide medical advice, diagnosis, or treatment
• Does not claim to cure, treat, or diagnose any medical condition
• Is not intended to replace professional medical consultation
• Should not be used as a substitute for professional healthcare advice

If you have concerns about sleep apnea, snoring, or any other health condition, please consult a qualified healthcare professional. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Eligibility

You must be at least 13 years of age to use Quietly. By using the App, you represent and warrant that you meet this age requirement. The App is designed for adults and its content is intended for users 18 years of age and older.

User Responsibilities

When using Quietly, you agree to:

• Use the App only for its intended purpose as a wellness tool
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that violates applicable laws or regulations
• Not distribute, license, or sell the App or any content within it
• Maintain the security of your device and any data stored locally

Intellectual Property

All content, features, and functionality of Quietly—including but not limited to text, graphics, logos, icons, audio, video, and software—are the exclusive property of Quietly and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

In-App Purchases

Quietly may offer in-app purchases. By making a purchase, you agree to the following:

• All purchases are processed through Apple's App Store
• Prices are displayed in your local currency and may vary by region
• Purchases are final and non-refundable, except as required by applicable law
• For refund requests, please contact Apple Support directly

Subscription Terms

If Quietly offers subscription services:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using Quietly, you agree to our Privacy Policy.

Disclaimer of Warranties

Quietly is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Quietly and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the App.

Indemnification

You agree to indemnify and hold harmless Quietly and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the App at any time by deleting it from your device.

Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms within the App or on our website. Your continued use of Quietly after such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with these Terms.
